 1.  Definitions

 "Smart Tag" refers to the physical tag with QR code and NFC technology that connects to the online memorial profile. "Online Memorial Profile" refers to the digital profile created to honor and remember the deceased. "User" refers to the person creating the online memorial profile.

 

2. Use of Services

The user agrees to use the services provided by Legacy Tag for personal and non- commercial purposes only. The user agrees to provide accurate and complete information when creating the online memorial profile.

 

3. Intellectual Property

The user retains ownership of all intellectual property rights in the content uploaded to the online memorial profile. Legacy Tag has the right to use, reproduce, and distribute the content uploaded to the online memorial profile for the purpose of providing the services.

 

4. Warranty Disclaimer

Legacy Tag provides the services on an "as is" and "as available" basis, without warranties of any kind, express or implied. Legacy Tag disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

 

5. Limitation of Liability

In no event will Legacy Tag be liable for any damages, including but not limited to incidental, consequential, or punitive damages, arising out of the use or inability to use the services. Legacy Tag's liability to the user for damages will be limited to the amount of fees, if any, paid by the user to Legacy Tag.

 

6. Indemnification

The user agrees to indemnify and hold harmless Legacy Tag, its officers, directors, employees, and agents from and against any claims, demands, actions, or proceedings arising out of or related to the user's use of the services.

 

7. Termination

Legacy Tag may terminate the services at any time, without notice, for any reason. The user may terminate the services at any time by deleting the online memorial profile.

 

8. Governing Law

These terms and conditions will be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or related to these terms and conditions will be resolved through binding arbitration in accordance with the rules of the Arbitration Foundation of South Africa.

9. Changes to Terms and Conditions

Legacy Tag reserves the right to modify or change these terms and conditions at any time, without notice. The user's continued use of the services will be deemed acceptance of any changes to these terms and conditions. By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not use our services.
